From a transactional perspective, the biggest misconception is that real estate law is all about forms, and there is a form for everything. This is far from the truth. Every transaction is different, with its own facts and circumstances giving rise to very different needs. Forms available online or at warehouse stores are very often incomplete, inaccurate, and not even enforceable in states like Texas, where we sometimes ride ourselves in the unique aspects of our property law. Consumers need assistance in what instruments are needed to fully document a transaction, inclusion of particular clauses to meet individualized needs, the proper way to fill out, execute and file the documents of record. This type of advice and instruction is simply not available to Texas consumers outside of retaining the services of a trusted, experienced real estate attorney.
